Sport and the Law

This
paper discusses the ethical and legal challenges raised
by the use of gene technology in sport. The focus is deliberately
broad, to provide a general framework of the legal issues
arising from the subject. Consequently, the paper discusses
four main parameters of gene technology: somatic cell modification,
germ-line cell modification, genomics, and genetic selection,
focusing on somatic cell modification and genetic selection,
as the most relevant and intriguing examples of applied
genetic science in sport. It argues that the legal implications
of gene technology for sport should limit the autonomy of
sports federations and call for a greater monitoring of
sport policy on performance development. Moreover, it is
argued there is a need for inquiry into the relative freedoms
of athletes and sports authorities to utilise gene technology
for performance. To ensure that injustices do not take place
as a consequence of ignoring contractual obligations, health-related
liberties, and entitlement to sporting participation, this
work should accompany ethical inquiry into the possible
harms of using genetic technology. Additionally, these concerns
should take into account the legitimacy of a range of scientific
research practices, such as the identification of performance
genes and the application of therapeutic genetic research
for injured athletes.
